Regional center investors must submit the new form when filing a petition for their EB-5 visa.
On 12th July 2022, USCIS published a new set of guidelines affecting investors preparing their petition for EB-5, an immigrant investor visa in the U.S.
Specifically, a new I-526E form is now required for petitions coming from regional center investors. USCIS stated a warning in case an improper form is used:
We will reject all Forms I-526 when it indicates that the petitioner’s investment is associated with a regional center. Petitions for classification under INA 203(b)(5)(E) should be submitted on Form I-526E.
Those applying with a direct EB-5 investment should continue using the I-526 form. All EB-5 petitions associated with a regional center with I-526 form will be rejected.
